Part D — Terms of entry
- These Terms must be read in conjunction with Schedules A (Weekly Skill Competition) and B (Grand Prize Draw). Where there is any inconsistency between these Terms and either Schedule, the relevant Schedule prevails for the component it governs. Participation in this Promotion is deemed acceptance of these Terms in their entirety.
- Entry is open only to Australian residents who satisfy the Method of entry and the eligibility requirements in each Schedule. Directors, officers, management, employees, suppliers (including prize suppliers) and contractors (and the immediate families of directors, officers, management, employees, suppliers and contractors) of the Promoter and of its related bodies corporate, and of the agencies and companies associated with this Promotion, are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
- The time zone applicable to any time stated in these Terms or the Schedules relates to Australian Eastern Standard Time (AEST), unless expressly stated to the contrary.
- Any prize is denominated and paid in Australian dollars unless expressly stated to the contrary.
- All vouchers issued in connection with this Promotion (including the Platinum Exchange Rate voucher) are valid until the expiry date stated on the voucher or by the provider of the voucher. Entrants agree to comply with any conditions which accompany the voucher. Neither the Promoter nor the voucher provider is liable for any voucher that has been stolen, forged, lost, damaged or tampered with in any way.
- Entrants are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Entrants are responsible for any and all expenses incurred in entering the Promotion and will not be reimbursed, regardless of whether they win.
- Entrants must follow the Method of entry during the Promotion Period to enter the Promotion. Failure to do so will result in an invalid entry. The Promoter will not advise an entrant if their entry is deemed invalid.
- The time of entry will be deemed to be the time the entry is received and verified by the Promoter (in the case of the Weekly Skill Competition, the time the creative response is submitted to the Promotion microsite; in the case of the Grand Prize Draw, the time of completion of the Qualifying Transaction).
- The Promoter accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence, whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise, including those entries not received by the Promoter for any reason. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. No correspondence will be entered into.
- Weekly Skill Competition prizes will be awarded to entrants whose entries are judged by the Judges to best meet the judging criteria set out in Schedule A. The Judges' decisions are final and no correspondence will be entered into. Grand Prize Draw entries will be drawn randomly in accordance with the draw details set out in Schedule B. The Promoter may draw additional reserve entries (and record them in order). In the event of an invalid entry or ineligible entrant, the prize will be awarded to the first reserve entry drawn.
- The winner does not need to be present at any draw or judging.
- Winners will be notified in accordance with the Notification provisions of the relevant Schedule. Notification to winners will be deemed to have occurred on the later of the time the winner receives actual notification from the Promoter or two (2) business days thereafter. The notification will include details about how the prize can be claimed.
- The Promoter takes no responsibility where it is unable to contact prize winners who have not provided correct or complete contact details. If an entrant's contact details change during the Promotion Period, it is the entrant's responsibility to notify the Promoter.
- It is a condition of accepting any prize that the winner must comply with all conditions of use of the prize. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
- If a prize cannot be awarded for any reason, including where the prize is no longer available, the Promoter may substitute it with a prize of higher or equal value, subject to any written directions from a regulatory authority. The Promoter is not permitted to deduct any administrative costs associated with the provision of the prize.
- By submitting an entry into the Weekly Skill Competition, each entrant warrants that their entry is their own original work, does not infringe the intellectual property rights of any third party, and does not contain any defamatory, obscene, offensive, threatening, abusive, harassing, discriminatory, or unlawful content. The Promoter reserves the right to disqualify any entry that does not comply with this clause. By submitting an entry, each entrant grants the Promoter a perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, adapt and publish the entry in any media for the purposes of conducting and promoting the Promotion and Crown Currency Exchange.
- As a condition of accepting any prize under this Promotion (whether under Schedule A or Schedule B), each winner agrees to participate, at the Promoter's reasonable request and within seven (7) days of prize claim, in promotional content capture activities. These may include photography and video filming at the winner's nominated Crown Currency Exchange store (including filming of the prize collection), a brief recorded or written statement from the winner about their experience with the Promotion or their travel plans, and being tagged by the Promoter in social media posts featuring the captured content. The Promoter will work with each winner on reasonable scheduling and location to enable participation. If a winner refuses or fails to participate in content capture as reasonably requested by the Promoter, the Promoter may, in its absolute discretion, withhold the prize and award it to the next valid entrant in accordance with the relevant Schedule.
- Each winner grants the Promoter, and its related bodies corporate and agents, a perpetual, irrevocable, royalty-free, worldwide and transferable licence to use, reproduce, modify, adapt, publish, broadcast and otherwise commercially exploit the content captured under the preceding clause (including the winner's name, image, likeness, voice and any statements provided) in all media now known or hereafter devised, for promotional, marketing, advertising and publicity purposes related to the Promoter and Crown Currency Exchange, without further notification, compensation or approval. Each winner consents, to the maximum extent permitted by law, to acts or omissions by the Promoter that would otherwise infringe their moral rights (within the meaning of the Copyright Act 1968 (Cth)) in respect of the captured content.
- If, despite the foregoing clause, the Promoter incurs a liability to an entrant under any law which implies a warranty into these Terms which cannot legally be excluded, the Promoter's liability is limited, in the Promoter's discretion, to either resupplying such goods or services as form part of the Promotion, or paying the cost of resupplying those goods or services.
- In no circumstances will an entrant or the Promoter have any liability to the other for any loss or damage suffered which is indirect or consequential in nature, including without limitation any loss of profit, loss of reputation, loss of goodwill, or loss of business opportunity.
- The Promoter and its associated agencies and companies will not be liable for any delay, damage, or loss in transit of prizes.
- The Promoter may in its absolute discretion not accept a particular entry, disqualify an entry, or cancel the entire Promotion at any time without giving reasons and without liability to any entrants, subject to any written directions from a regulatory authority. The Promoter reserves the right to verify the validity of entries, prize claims and entrants, and to disqualify any entrant who submits an entry or prize claim that is misleading or not in accordance with these Terms, or who manipulates or tampers with the entry process.
- The Promoter collects personal information about entrants to conduct the Promotion. If the information requested is not provided, the entrant may not be able to participate. By entering the Promotion, entrants consent to the use of their personal information by the Promoter for the purposes of conducting this Promotion and for marketing communications (where opt-in consent has been provided). The Promoter's Privacy Policy, including details of how entrants may access or correct their personal information or complain about a breach of the Australian Privacy Principles, is available at crowncurrency.com.au/privacy.
